Terms and conditions
The German version is authoritative.
1. Scope
These terms apply to all workshops offered by Julian Handl, sole proprietor, Mannersdorf 38, 3393 Zelking-Matzleinsdorf, Austria (VAT ID: see imprint; the “provider”). There are two kinds: open workshops with fixed dates that individuals sign up for on the website, and company workshops that companies book on request. The “customer” is whoever books a workshop; a “consumer” is a customer who concludes the contract mainly for private purposes.
Different terms of the customer apply only if the provider confirms them expressly in writing.
2. Conclusion of the contract
Open workshops: Signing up on the website is a binding offer by the customer. The contract is concluded when the provider confirms the signup by email, which happens right after signing up. Signing up creates a customer account. Seats per date are limited and are given out in the order of signups.
Company workshops: A free intro call is non-binding. The provider then makes an offer. The contract is concluded when the customer accepts the offer.
3. Workshop language and content
Each workshop is held in the language stated for the workshop or the booked date. Content and schedule follow the description on the website or in the offer. The provider owes a careful delivery of the workshop, not a particular business result such as a certain time saving.
4. Prices and VAT
Prices are shown on the website as a net price and as a gross price including 20% VAT. Consumers pay the gross price. For businesses, the net price plus statutory VAT applies. Open workshops cost the stated price per person. Company workshops cost the price stated in the offer; if the workshop takes place on site, the provider's travel costs are added.
5. Payment
The provider sends the invoice by email to the address given at signup. The invoice amount is payable by bank transfer within 14 days of the invoice date without deduction, for open workshops at the latest by the start of the workshop. For company workshops the payment terms of the offer apply; unless agreed otherwise, 50% is due on order and 50% after the workshop. In case of late payment, statutory default interest applies.
6. Cancellation by the customer (open workshops)
The statutory right of withdrawal of consumers is set out in the withdrawal notice and remains unaffected. In addition, the customer can cancel the signup by email or in the customer portal:
- up to 14 days before the workshop starts: free of charge,
- from 14 to 7 days before the start: 50% of the price,
- less than 7 days before the start or in case of a no-show: 100% of the price.
The customer can name a substitute participant at any time, free of charge.
Cancelling in the customer portal releases the seat; an amount owed under this rule is invoiced.
7. Cancellation and rescheduling for company workshops
The terms of the offer apply. Unless agreed otherwise, the following applies if the customer cancels or reschedules:
- up to four weeks before the workshop starts: free of charge,
- after that, up to one week before the start: 50% of the price plus the full travel costs,
- less than one week before the start: 100% of the price plus the full travel costs.
If the workshop is rescheduled, the share of the price charged under this scale is credited in the final invoice for the workshop, provided the workshop takes place within six months of the original date.
Travel costs only arise if the workshop takes place on site.
8. Cancellation or change by the provider
The provider can cancel or move a date for good cause, such as illness, force majeure or too few participants. The customer is informed without delay. They can then attend a replacement date or get amounts already paid refunded. Further claims are excluded where legally permitted.
9. Delivery and materials
The workshop takes place remotely or at the location stated for the date or in the offer. The customer provides the technical prerequisites named in the description. Documents and materials remain protected by copyright and may only be used for the customer's own purposes, not copied or passed on.
10. Data protection
The privacy policy applies. In company workshops the provider works in the customer's own accounts; a data processing agreement is available on request.
11. Liability
The provider is liable without limit for intent, gross negligence and damage to life, body or health. Towards businesses, liability for slight negligence is excluded where legally permitted, and liability for lost profit and indirect damage is limited. It is capped at the price of the booked workshop. Towards consumers, statutory liability applies.
12. Final provisions
Austrian law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection rules of their country of habitual residence remain unaffected. The place of jurisdiction for businesses is the competent court at the provider's seat. Consumers can lodge complaints with the EU online dispute resolution platform: https://ec.europa.eu/odr.
If a provision is invalid, the rest remains valid. Changes to these terms apply only to contracts concluded after the change.
